People who work with children are convicted of sexual abuse should not return to their profession

What happens today with teachers who have been convicted of crimes of child abuse and sexual exploitation and child pornography? As we read a week ago in some media (the news is not that it had much echo), after serving their sentences they return to school, which again poses a risk to children.

I believe that society should not allow people who have such crimes to have contact with children again. Moreover, once the crime is proven, and the subject in question convicted of him, perhaps there should be a register of sex offenders accessible to institutions that work with minors, as in other countries. Now is not the time to think about whether rehabilitation is possible (I think not, everyone who does the same with their criteria), but to protect children. Therefore, the Department of Education of the Generalitat de Catalunya, intends to submit a proposal on the modification of the Government Criminal Code.

This proposal would be presented through the CiU parliamentary group in the Congress, and would consist in requesting the inclusion of definitive expulsion from the educational system, of teachers convicted of the crimes mentioned above.

The objective is to prevent these people from having direct and regular contacts with minors again, and for this they should be temporarily or permanently disable the exercise of activities (at least professional) that involve being with children.

It seems that the bill amending LO 10/95 of the Criminal Code does not take into account an article of the European directive 2011 / 92UE on the disqualification derived from convictions; In fact at present, disqualification only takes effect during the time of conviction.

We should be horrified that at present, a person who works with children (be it teacher, or monitor, caregiver, etc.) and is convicted of school abuse, may request to return to their usual profession, and that is the reality.

The proposal of the Generalitat is not against the reinsertion measures, but in favor of childhood. In the same vein, if there were records, it could prevent, identify and collect data on abuse, sexual exploitation and child pornography, something that does not provide for the new draft Criminal Code.

This news is encouraging, and one would expect the proposed modification to be accepted.
