State Pact against Gender Violence: we summarize the main measures in favor of women and their children

The political parties have sealed a historic agreement to deal with one of the biggest blunders of our society: gender violence. The plenary of the Congress has approved the State of Gender Violence pact with the affirmative votes of 278 deputies and 65 abstentions of the representatives of Unidos Podemos and some of the Mixed Group.

It consists of a plan of 213 measures and a budget of 1 billion to deal with sexist violence, and we summarize here the main measures agreed to protect mothers and their children.

  • The Victim status for mothers whose children have been killed by their partners or former partners to harm them.

  • Victim status will be extended to women who have not yet filed a criminal complaint, so that they can access the resources of protection and integral attention.

  • Be suppress mitigating sentences for abuse, such as confession of crime or reparation of damage in crimes of gender violence.

  • The criminalization of crimes in the digital sphere will be perfected, so that, insults and slander are not considered only a misdemeanor.

  • Children of children of victims of violence will have psychologist and pedagogical support.

  • Will be created protocols in primary health care and emergency so that doctors contribute to detect possible victims when the first abuses occur.

  • The orphans will have Priority access to orphan's pensions and scholarships, and whoever has his guard and custody will have priority to access protective housing.

  • There will be no joint custody for abusive parents: the visitation regime will be suspended and it will be prohibited for minor children to go to jail to see their parents.

  • Be will force battered women to testify. He remembers “Avoid spaces of impunity” which are derived from current legislation, which dispenses the victim from the obligation to testify in a trial.

  • Abused women without resources will receive a six month unemployment benefit of duration.

  • Design a accompaniment and advice plan of the victim

  • Strengthen free legal assistance to women victims before, during and after the judicial procedure.

  • Include children in the risk assessments of the victims.

  • Prevent gender violence at all educational stages: promote activities to prevent sexual violence, include content of equality and against gender violence in the topics, emotional and sexual education based on equality.

  • Develop prevention and awareness campaigns.

  • Protect victims in international subtraction situations of minors, whose origin is an episode of gender violence.
