Do you need to passport your baby? The new regulation requires the express authorization of both parents

It was time. Less than a month ago, a much-needed measure to protect children from parental abductions came into force. The new requirements to request the baby's passport require the express authorization of both parents.

Before the change, only one parent's authorization was required. It was enough with the presentation of the DNI of the person who accompanied the minor and exercised parental authority over the minor, that is, only the mother or father could go. As of June 26, a new regulation for the issuance of the passport of minors requires the express consent, not only of both parents, but where appropriate, of all persons exercising their guardianship, before the office where the document or notary public.

In this way, the measure adapts to the different resolutions of the international organizations of which Spain is a part and intends to prevent children from leaving the country irregularly, without the consent of any of the parents and thus prevent kidnappings parental

We know very sad stories of children who have been kidnapped by one of their parents before the separation of the parents. The harm to the child is tremendous, so it is good news that children are protected from abuse of this kind.

Then the new requirements for issuing the baby's passport They are:

  • Compulsory physical presence of the interested party is collected in the dispatch office.

  • As with the DNI, the literal birth certificate that is presented for obtaining the passport must have a maximum validity of 6 months and the entry that is issued for the issuance of the passport.

  • For the issuance of the passport to minors or disabled persons, the express consent of those who have attributed the exercise of parental authority or guardianship, of all, must be granted. Important change introduced according to the previous regulations since, now, All legal representatives must give consent: both parents if any or all guardians if more than one had been appointed. And they have to do it appearing directly and personally before the office where the issuance of the passport is carried out, or authorizing each other or third parties, but before a notary public, that is, Spanish notaries, General Consuls, or foreign notaries, in which case the power of attorney must come duly legalized

  • A new requirement is introduced in relation to parents and guardians, who will be required to prove the relationship, or guardian status, by submitting any official document in this regard.

  • To provide authorization, Spanish citizens will identify themselves with their ID and foreigners with the Foreigner Identity Card, their nationality passport, or their country's identity card for nationals of those countries that, by virtue of the International agreements, you can travel and enter Spain with your identity document. All documents must be in force.

  • For the rest, the same documents are needed before the change, and do not forget the baby's photo card. It is usually quite frequent to carry all documents and forget about the simplest.
