Now, the Court of First Instance number 21 of Madrid has condemned the Andalusian Health Service (SAS) to pay 4.2 million euros to a girl with cerebral palsy because of different medical errors in childbirth, which took place in a Sevillian public hospital in 2015.

Delayed caesarean section and other medical errors

As explained in the sentence, the mother entered, after breaking waters, in a public hospital in Seville about 12:50 on February 5, 2015. At that time, they detected the presence of meconium (baby's first poop), which obliges to advance the delivery before the possible risk to the fetus.

However, the cesarean section was not performed until almost four hours later and ended at 17:10 hours. The baby had a lack of oxygen (hypoxia), which caused serious consequences: cerebral palsy, blindness, severe tetraparesis and psychomotor retardation.

According to the judges, 80 percent of the girl's recognized disability was caused by lack of birth control, the absence of fetal scalp pH (test that is performed during active labor to check if the baby is getting enough oxygen) and why:

"Caesarean section was belatedly indicated and practiced, resulting in acute fetal suffering with hypoxia-ischemia, presenting the one born at 30 minutes of life, whining and nasal flutter, characteristic of that lack of oxygenation. There was a causal relationship between intrapartum hypoxia and lesions. neurological. "

The SAS must pay the family 1.5 million euros and the insurance company, Zurich, 2.7 million euros. The ruling is appealable within 20 days.
